What is Included in My HOA Dues?

In general, the condominium’s Homeowners Association (HOA) is responsible for overseeing the care of the common/shared areas of the property, such as grounds and landscaping, recreational facilities, lobby, elevator, hallways, roof, etc., and for maintaining a Reserve account to protect the owners against the need for special assessments for major expenses (painting the exterior, replacing the roof, and so on) that may arise in the future. An annual budget and regular Reserve studies evaluate these costs and help the condominium’s Board of Directors to determine the amount that owners need to contribute in monthly dues.wilshire thayer

In some cases, all units pay an equal fee each month. In other cases, HOA dues are determined by unit square footage. What’s included is specific to each building. Some associations include only the most basic maintenance and a small amount toward Reserves; in other buildings, HOA dues may cover air, heat, cable, water, management company, valet, security service, pool, spa, gym, earthquake insurance, fire insurance and many other amenities.

HOA dues are defined in each building’s official documents and specified in the paperwork for the purchase of a condominium. The association’s Covenants, Conditions & Restrictions (CC&Rs) will also spell out the procedure for changes to HOA dues. In California, laws regarding Common Interest Developments, including condominiums, are part of California Civil Code Title 6. Sections 1366-1367.5 cover the subject of assessments, including how they are levied, increased, and approved, and what measures the HOA can take if a homeowner fails to pay their dues or other assessments.

Be sure you understand exactly what is covered by your HOA dues before you complete your purchase transaction. As a buyer, you are entitled to review HOA documents, including the CC&Rs and the budget, and you should take the time to look them over carefully.
